Is the charge enforceable?

ParkMaven has the authority to issue and enforce Parking Charge Notices for contractual breaches on private land: When entering and remaining on private land, a motorist freely enters into an agreement to abide by the conditions of parking, the Parking Charge Notices (PCNs) are therefore issued on the basis of a breach of the contract with the motorist, which is set out via the signage at the site. 

 

Our BPA approved signage is clearly visible throughout the carpark. This outlines the terms and conditions under which a motorist is authorised to park, and that a PCN may be issued if these conditions are not met. Motorists may authorise their vehicle to park through paying a parking tariff, validating their parking session using a tablet or QR code where appropriate, or remaining within a limited period, or similar. 

 

We don’t hide our signs in the hope of catching people out. With an average of 1 sign for every 5 bays within our carparks, we offer motorists ample opportunity to read signage, obliging them to comply.
